We won Domain Dispute against Findanet.Ltd (Findateacher.net & Senseisagasu.com)
We successfully filed a lawsuit against Findanet.Ltd (Findateacher.net & Senseisagsu.com) at the Yokohama District Court over the purchase and use of a similar Internet Domain Name (a-kaiwa.com) in an attempt to draw away customers. We demanded compensation and the deletion of the domain name.
Accepting an unreserved apology from FindaNet and the pledge that they will never again use any similar domain names, we reconciled the matter and the case was settled.
Reconciliation Provisions
1. The defendant will verify that all domain names registered by the defendant 「a-kaiwa.com｣ ｢a-kaiwa.tv｣「a-kaiwa.org」「a-kaiwa.fm」are deleted.
2. The defendant will admit that the domain name 「a-kaiwa.net」 registered and used by the plaintiff is owned by the plaintiff and subsequently apologize about using the domain name and causing an inconvenience to the plaintiff.
3. The defendant shall never use or register a domain name containing 「a-kaiwa」, regardless of it being a top level domain
4. The defendant shall not use or register domain names such as 「akaiwa」etc that are highly similar to 「a-kaiwa」.
5. The plaintiff shall waiver the right to compensation for this case.
