We, at A kaiwa Net (hereafter described "we" or "A kaiwa Net ") have created this privacy policy to demonstrate our company commitment to protecting your personal information and informing you about how we handle it. This privacy policy only applies to transactions and activities in which you engage, and data gathered, on the web site a-kaiwa.net (hereafter described "we", or "the Site "). Please review this privacy policy periodically as we may modify it from time to time. This privacy policy was created on May 9th, 2003.
Information We Collect From You
In order to operate the Site and to provide you with information about our services, we may collect "personal information" (i.e. information that could be used to contact you directly (without using the Site) such as full name, postal address, phone number or email address.

How We Use Personal Information
We use your email address and your other personal information to help us efficiently operate the Site, to contact you in connection with your transactions and other activities on the Site (including, but not limited to, confirmation emails or important news that could affect your relationship with "A kaiwa Net"), and to forward messages to you from other users of the Site and our service.

Changing our Privacy Policy for Previously Gathered Information
If at any point we decide to use particular personally identifiable information in a manner different from that stated at the time it was collected, we will notify users by way of an email or by providing 30 days notice on the Site. Please note that we will continue to have the right to change our privacy policy and practices, and how we use your personally identifiable information, without notice, as described in the first paragraph of this Privacy Policy, provided that such changes shall only apply to information gathered on or after the date of the change.
How You Can Access and Update Your Personal Information and Public Information
We give you the opportunity to opt-out of certain communications and modify personal information at anytime by going to "My Profile" section of the Site. Please be aware that it may take several hours for the changes you make to take effect on the public areas of the Site. We thank you for your patience. Please note that changing or deleting your information through the "My Profile" section of the Site, or otherwise opting-out of receipt of email communications from "A kaiwa Net", will only change or delete the data in our database for purposes of future activities on the Site and for managing future communications from "A kaiwa Net".
Terms of Use Agreement
The service for students and teachers to meet each other online operated by "A kaiwa Net". By using the "A kaiwa Net" web site (the "Web site") you agree to be bound by these Terms of Use (this "Agreement"). If you wish to register to the "Web site" and communicate with other teachers and make use of the service of "A kaiwa Net" (the "Service"), read these Terms of Use and indicate your acceptance of them by following the instructions in the Registration process. This Agreement sets out the legally binding terms of your use of the Web site and your use of the Service and may be modified by "A kaiwa Net" from time to time, such modifications to be effective upon posting by "A kaiwa Net" on the Web site.
Eligibility
You must be an individual, over 18 years old, residing in Japan or planning to live in Japan within 3 months, to register to the Web site. By using the Web site, you represent and warrant that you have the right, authority, and capacity to enter into this Agreement and to abide by all of the terms and conditions of this Agreement.
Term
This Agreement will remain in full force and effect while you use the Web site and/or are a Member. You may terminate your registration at any time, for any reason by following the instructions on the Resign pages in My Profile, or upon receipt by "A kaiwa Net" Net of your written or email notice of termination. "A kaiwa Net" may terminate your registration for any reason, effective upon sending notice to you at the email address you provide in your registration form, or such other email address as you may later provide to "A kaiwa Net". If "A kaiwa Net" terminates your registration because you have breached the Agreement, you will not be entitled to any refund of unused subscription fees. Even after registration is terminated, this Agreement will remain in effect.
Illegal and/or unauthorized uses of the Web site, including collecting usernames and/or email addresses of members by electronic or other means for the purpose of sending unsolicited email and unauthorized framing of or linking to the Web site will be investigated, and appropriate legal action will be taken, including without limitation, civil, criminal, and injunctive redress.
Proprietary Rights in Content on "A kaiwa Net"
"A kaiwa Net" owns and retains all proprietary rights in the Web site and the Service. The Web site contains the copyrighted material, trademarks, and other proprietary information of "A kaiwa Net".
Disputes
You are solely responsible for your interactions with other teachers registered to the Site. "A kaiwa Net" reserves the right, but has no obligation, to monitor disputes between you and other teachers.
If there is any dispute about or involving the site and/or the service of the site, by using the site, you agree that the laws of Japan without regard to its conflict of law provisions will govern the dispute. You agree to personal jurisdiction by and venue in Japan and the courts of Japan.
Privacy
Our Privacy Policy also governs use of the Web site and/or the Service.
Disclaimers
"A kaiwa Net" is not responsible for any incorrect or inaccurate content posted on the Web site or in connection with the Service, whether caused by users of the Web site, teachers (members) or by any of the equipment or programming associated with or utilized in the Service. "A kaiwa Net" is not responsible for the conduct, whether online or offline, of any user of the Web site or user of the Service. "A kaiwa Net" assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, user or communications. "A kaiwa Net" is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of email or players on account of technical problems or traffic congestion on the Internet or at any web site or combination thereof, including injury or damage to users and/or teachers or to any other person's computer related to or resulting from participating or downloading materials in connection with the Web and/or in connection with the Service. Under no circumstances will "A kaiwa Net" be responsible for any loss or damage, including personal injury or death, resulting from anyone's use of the Web site or the Service, any Content posted on the Web site or transmitted to teachers and students, or any interactions between users of the Web site, whether online or offline. The Web site and the Service provided "A kaiwa Net "expressly disclaims any warranty of fitness for a particular purpose or non-infringement. "A kaiwa Net" cannot guarantee and does not promise any specific results from use of the Web site and/or the Service.
Limitation on Liability
In no event will "A kaiwa Net" be liable to you or any third person for any indirect, consequential, exemplary, incidental, special or punitive damages, including also lost profits arising from your use of the site or the service of the site, even if "A kaiwa Net" has been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, the liability of "A kaiwa Net" to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to the site for the service during your use.
